Responsibility of JOINUP regarding intermediation services:

General contracting conditions

The contract signed between the user and JOINUP will enter into force at the time that JOINUP provides the user with confirmation of the reservation or immediate parking or taxi service through the App, or in writing by email.

Events beyond our control

JOINUP will not be responsible for any breach or delay in the fulfillment of any of the obligations assumed, when it is due to events that are beyond our reasonable control.

These will include any act, event, failure to exercise, omission or accident that is beyond our reasonable control and, among others, the following:

  • Strikes, demonstrations, lockouts or other protest measures.
  • Adverse weather conditions.
  • Civil commotion, riot, invasion, terrorist threat or attack, war (declared or undeclared) or threat or preparation for war.

Rules for the use of services through the Means of requesting services available to users

For the purposes of The Means of request , JOINUP, understands by “users” the natural or legal persons who require the provision of taxi services and who use it to request it The Application Means , having been previously registered on the platforms authorized by JOINUP, or accessing from the Website and/or mobile applications, and having duly registered, and accepted the conditions of service.

The provision of the Means of application does not include possible telephone calls that the user decides to make. The user is responsible for the cost of said calls.

All rights to the software are the property of JOINUP. The software made available to the user may not be copied, modified, reverse developed, decompiled or disclosed.

Assignment of Rights and Obligations


The contract is binding for both the user and JOINUP. The user may not transmit, assign, encumber or in any other way transfer a contract or any of the rights or obligations derived from it, without having obtained, at any time during its validity, the prior written consent of JOINUP. To avoid any doubt, such transmissions, assignments, encumbrances or other transfers will not affect the rights that, where appropriate, the user, as a consumer, has recognized by law, nor will they cancel, reduce or limit in any other way the guarantees, both expressed or tacit, that we could have granted.

Modifications

JOINUP reserves the right to make any changes it deems appropriate, without prior notice, to the content of its web site. JOIN-UP SERVICES

a) General terms and conditions of use of the Means of Request for all services.

3. Service availability

b) Terms and conditions of use of Applications and web for taxi service request.

1. Applicable regulations and prices

2. Object

  • Request a taxi reservation on a scheduled basis.

3. Process

Should a taxi service request be made through any of the JOINUP Means of Request, the system will guide Users through the different stages of the process and how to make the payment.

  • Confirmation of the request for a taxi service will be sent to Users through the Means of Request, or by email.
  • From the moment Users request a service, JOINUP acts as an intermediary between Users and the Taxi Provider, transmitting the data thereof to the Taxi Provider and informing Users.

4. Cancellation of services

Where Users need to cancel the requested service when the taxi is assigned to their service, a cancellation fee will be applied.

5. Payments

User payments will be made via mobile application by credit card in force, by debit card or cash in the taxi itself, these payment options vary depending on the location where the service is requested. Payments via the mobile application are made through a secure payment gateway contracted by JOINUP.

For an Employee, if the service is performed as a professional service, payment shall be made in accordance with JOINUP’s terms and conditions with their employer.

c) Terms and conditions of use of Applications and web for parking service request.

1. Object

The application and request via the web, hereinafter “ The Application Means ”, have been created with the aim of providing a tool that facilitates the user in the parking application procedures, allowing:

2. Purchase Process

In the event that a parking reservation is made through any of the JOINUP Contracting Means, the system will guide the user through the different phases of the process and how to make the payment. The confirmation of a reservation or the request for an immediate service, which gathers the essential elements, such as the information of the reserved Services and the price, will be sent to the user through the App or website, or by email.

From the moment the user makes their reservation, JOINUP acts solely as an intermediary between the user and the Parking Provider, transmitting the reservation data to the Parking Provider and informing the user.

In providing its Service, the information displayed by JOINUP is based on information provided to it by the Provider. Although JOINUP tries to make its Service as accurate as possible, it cannot verify or guarantee that all information is accurate, complete or correct.

The Means of Request display confirmation windows in various sections of the purchase process that do not allow you to proceed with the order if the data in these sections have not been provided correctly. Likewise, they offer the information of all bookings during the purchase process, so that, before making the payment, Users may modify the details of their order.

If Users detect an error in their order after the payment process has been completed, they should immediately contact our Customer Service Department, at the e-mail address hola@joinup.es, to correct the error.

By making the purchase, Users expressly accept the conditions of access and use in force in the car park or car parks they are going to use, and understand that these rules are dictated exclusively by the Provider.

In the case of the purchase of a monthly, quarterly, semi-annual, annual subscription, or of another duration, the user understands and accepts that to access the contracted service they must sign a contract with the parking Operator that provides it, and that there is a minimum duration of that contract to be able to access the conditions offered. In case of not agreeing with this contract, the user may cancel or modify their stay before 11:59 p.m. on the day following the arrival date indicated in the purchase process, notifying JOINUP.

3. Responsibility

JOINUP, through its Platform, provides users with data, information and services related to the management of parking resources. To benefit from these services, the user provides information, in particular when reserving or requesting a Service, as well as when registering to access the private page of his user account.

JOINUP has agreements with parking operators who are responsible for the service corresponding to the parking product offered for sale through JOINUP. However, JOINUP is responsible for the security of the online payment, as well as for giving reserved access to the reservation information to the Provider.

When making the purchase, the user expressly accepts the conditions of access and use in force in the car park, or car parks, that he is going to use, and understands that these rules are dictated exclusively by the Provider.

In no event, including without limitation negligence, shall JOINUP be liable for damages of any kind against vehicles, persons or property, including without limitation any direct, indirect or expressly advised damages, arising out of, or in connection with, the access, use or exit from the car park or car parks.

JOINUP makes every effort to provide photographs and illustrations that offer the User a visual representation of the Services offered. 4. Amounts and payment

The price of the services will be the one that appears on the Platform at all times, except in cases of obvious error. Prices may change at any time, but changes will not affect reservations that have already been confirmed. Sometimes on our Platform there is a cheaper rate for a specific service, product or stay. However, these rates made available by the Providers may carry restrictions and special conditions, for example, regarding cancellation and reimbursement. The user must consult the data and conditions of the reservation, the corresponding service or product in detail to know the conditions before making the reservation.

The final amount includes: the price of the reservation, the possible management fees, the applicable taxes, and the possible discounts that have been applied. This breakdown is indicated to the user at the time of booking and payment confirmation and must have been accepted by the user.

Unless otherwise specified, the prices of the Services that appear on the Platform are expressed in the currency of the country in which the Service is provided.

Users can pay for the booking by means of accepted and valid credit cards, or if they choose to pay for the service as an Employee, payment shall be made in accordance with the terms and conditions that JOINUP has agreed with their employer.

If a refund is due to the User, JOINUP will transfer the amounts in question to the card used to make the original booking. In the case of Employees, JOINUP will deduct the amounts concerned in accordance with the means of payment contracted with their employer. Management costs shall not be eligible for refund.

Under no circumstances shall Users be entitled to subsequent reimbursement of the time not used if they decide to end their stay before the end time indicated in their booking.

5. Cancellation and modification policy

JOINUP provides Users with various options (outlined below) to cancel or modify a booking and to proceed to refund the purchase.

The cancellation and refund of the purchase are associated with each reserved car park and product, as informed to the user in the conditions associated with the car park and product when making the space reservation.

The cancellation or modification policy applicable to each reserved product is specified in the legal conditions, in the confirmation email that the user receives after completing the purchase process and in the reservation receipt that the user must validate upon arrival at the car park. .

Products with mandatory cancellation and modification policy before 11:59 p.m. (local parking time) the day before the arrival date confirmed in the reservation or receipt :

  • Users can modify their monthly, quarterly, half-yearly or annual subscription reservation free of charge until 11:59 p.m. the day before they arrive at the car park.
  • Users can cancel their monthly, quarterly, half-yearly or annual subscription reservation free of charge until 11:59 p.m. the day after their arrival at the car park.
  • When buying a monthly subscription at JOINUP, with the permanence defined by each car park, the user enjoys a discounted price compared to the normal retail price. In the event that the user decides to cancel their monthly, quarterly, semi-annual or annual subscription within the permanence period, the user understands and agrees to pay the car park the difference between the discounted price and the normal retail price for each month that have been in the parking lot.

Exceptions in which the cancellation and/or modification policies mentioned above are not applicable:

  • Guadeloupe and Martinique airports (France): for reservations made at the Guadeloupe and Martinique airport car parks, cancellations or modifications may be requested until 6:00 p.m. (Guadeloupe and Martinique local time) the day before the date. confirmed in the reservation and in the receipt.
  • Nice Airport (France): for reservations made in the official car parks of the Nice-Côte d’Azur Airport, the amount of the reservation will be refunded as long as the cancellation is requested at least 48 hours before the confirmed arrival time. in the reservation and in the receipt.
  • Garage d’Abbeville (Paris, France): the Garage d’Abbeville car park does not accept the cancellation of the reservation or its refund under any conditions.

How to proceed with the cancellation and/or modification of a reservation:

Cancellations for products by hours/days:

  • The cancellation is free as long as it is within the period allowed to cancel the reserved parking and product, and the user manages it from their user account.
  • The cancellation does not include the refund of the management costs derived from the purchase of the product.

Cancellations for monthly, quarterly, semi-annual or annual subscriptions:

  • As long as it is within the period allowed to cancel, this type of reservation can only be canceled through our Customer Service Department, indicating the reservation locator by email to hola@joinup.es
  • Cancellation management by the Customer Service Department will be free of charge, although, as Users enjoy a discounted price with respect to the normal retail price, Users understand and accept to pay the car park the difference between the discounted price and the normal retail price for each month that they have stayed in the car park.

Modifications for products by hours/days:

  • The modification is free if the user manages it from their user account.
  • The gratuity does not include the additional costs derived from the extension of the reservation. These costs will be automatically charged to the same card that the user provided at the time of registration in JOINUP.

Modifications for monthly, quarterly, semi-annual or annual subscriptions:

  • Provided that it is within the period allowed to make a modification, this booking can only be modified through our Customer Service Department, indicating the booking locator by email hola@joinup.es. Once the contracted commitment period (whether monthly, quarterly, half-yearly or annual) has begun, it is not possible to modify the booking, but only to cancel it.
  • The management of the modification by the Customer Service Department will be free.

d) Specific terms and conditions of use of electric recharging service.

1. Purpose

«The Means of request», have been created in order to provide a tool that facilitates Users the procedures of recharging their vehicles, allowing them to:

  • Recharge at the chargers of the different energy operators available in the Means of Request.

2. Process

Should a parking booking or electric recharge be made through any of JOINUP’s Means of Request, the system will guide Users through the different stages of the process.

Once Users have recharged, JOINUP acts solely as an intermediary between Users and the available Energy Providers, transmitting the booking data to the said Providers and informing Users.

The information displayed by JOINUP is based on information provided by the Provider. Although JOINUP tries to make its Service as accurate as possible, it cannot verify or guarantee that all information is accurate, complete or correct.

The Means of Request display confirmation windows in various sections of the purchase process that do not allow you to proceed with the order if the data in these sections have not been provided correctly.

If Users detect an error in their order after the payment process has been completed, they should immediately contact our Customer Service Department, at the e-mail address hola@joinup.es, to correct the error.

3. Liability

JOINUP, through its Platform, provides Users with data, information and services related to the management of recharge point resources.

JOINUP has agreements with electricity operators who are responsible for servicing the electric recharging product offered for sale through JOINUP.

By making the purchase, Users expressly accept the conditions of use in force for each charger, or chargers, to be used, and understand that these rules are dictated exclusively by the Provider.

Under no circumstances, including but not limited to negligence, shall JOINUP be liable for any damages whatsoever to vehicles, persons or property, including but not limited to direct, indirect or expressly advised damages, arising out of or in connection with the vehicle recharging process.

4. Amounts and payment

The User will pay a registration fee at the time of the first recharge. The Employee shall not pay this fee.

The price of energy is the one that appears in the Means of Request at any given time and is set by each Energy Provider. Prices change periodically as energy prices rise or fall. Users will be able to see the price of energy for each charger in the Means of Request, before recharging.

The final amount includes: the price of the energy consumed, and the applicable management fees and taxes.

Users can pay their bookings by means of accepted and valid credit cards, or if they choose to pay for the service as an Employee, payment shall be made in accordance with the terms and conditions that JOINUP has agreed with their employer.

If a refund is due to the User, JOINUP will transfer the amounts in question to the card used to make the original booking. In the case of Employees, JOINUP will deduct the amounts concerned in accordance with the means of payment contracted with their employer. Management costs shall not be eligible for refund.

Notifications

The applicable regulations require that part of the information or communications that JOINUP sends to its users be in writing. By using this Platform, the user accepts that said communications with JOINUP are electronic.

JOINUP will contact the user by email or provide information by posting notices through the web or App. For contractual purposes, the user consents to use this electronic means of communication and acknowledges that the contract, notification, information and other communications that JOINUP sends them electronically comply with the legal requirements of being in writing. This condition will not affect your rights recognized by law.

The notifications that the user sends to JOINUP must be made through the email address hola@joinup.es. In accordance with the provisions of the previous clause and unless otherwise stipulated, JOINUP may send communications to the email provided by the user at the time of making the purchase. The user will be able to have an automatic notification when their request has been received on our support platform. The applications received will be managed in strict order of entry, although priority will be given to those that are considered urgent due to force majeure.

JOINUP may send notices to Users regarding the use of the service, commercial communications, new services available, etc. by email or via the Means of Request, these notices will be sent directly by JOINUP’s own means or by its external communications provider.
